CYBERSUITE X PRIVACY POLICY

This Privacy Policy is effective as of  January 1, 2021.

Cybersuite Inc. (“Cybersuite”, “we”, “our”, “us”) recognizes the importance of your right to privacy and wants you to be familiar with how we collect, use and disclose any personal information that individually identifies you (e.g. name, phone number, e-mail address).

This Privacy Policy explains our information practices and describes how we collect, use, process and disclose your personal information when you use our Platform and Services, as described in the Terms of Use. Personal information means any information about an identifiable individual, but does not include the name or business contact information of an employee of an organization. We will only collect, use and disclose your personal information in accordance with this Privacy Policy.

By using our Platform or Services and supplying your personal information, you acknowledge that you have read and understood this Privacy Policy, and you agree and consent to the collection, use, disclosure and other processing of your personal information as outlined in this Privacy Policy. If you do not agree to the terms of this Privacy Policy, please do not use our Platform or Services or supply your personal information to us.

1. What and Why

Personal information means any information about an identifiable individual.

We may collect personal information from you when you voluntarily provide it to us through a number of features available via the Platform or Services.  We limit the collection of personal information to that which is necessary to fulfill the purposes identified in this Privacy Policy and we collect, use and disclose your personal information in accordance with this Privacy Policy.

We will only use the personal information that we collect for the purposes for which it was collected. We collect, use and disclose your personal information in order to provide you with our Platform and Services.

We also collect, use and disclose your personal information to comply with legal and regulatory requirements and as otherwise may be permitted or required by applicable laws. We will only use the personal information that we collect for the purposes for which it was collected. We collect your personal information for the following purposes and in accordance with applicable laws:

Account. We collect, and associate with your account, personal information like your name, email address, phone number, and physical address. Some of our Services let you access your accounts and your information with other service providers.

Contact Information.  If you contact anyone through our Platform, e-mail or by some other means we may ask you for personal information such as your name, address, phone number, physical address or e-mail address so that we can respond to your query).

Content. When you provide content, we may collect, use, process and store your that information.

Services. When you use our Services, we collect, store, process and transmit your information (including your appointments, bookings, emails) and information related to them.

Cybersuite does not consider personal information to include anonymous data. Anonymous data means data that is not associated with or linked to any individual’s personal information or will not easily permit the identification of individuals.  

2. How Do We Collect Personal Information?

We may collect your personal information when you voluntarily provide it to us by using our Platform or Services. For example, we may ask you to provide personal information if you:

  • use our Platform or Services;
  • sign into your account;
  • communication via the messaging module;
  • making bookings through the amenities modules;
  • purchasing any services through modules and
  • send us a question or comment by email or phone.

3. How and why do gather personal information through automatic means?

Usage. We collect information from and about the devices you use to access our Platform and Services. This includes things like IP addresses, and device you use and identifiers associated with your devices. Your devices (depending on their settings) may also transmit location information to the Platform or Services.

Operational Data. When you use our Platform and Services, we collect, store and process operational data, such as your last sign on.  We use this data to help you get maximum use from our Platform and Services and improve your user experience and security.

4. How do we Use and Retain your Personal Information?

Your personal information will not be used without your consent for purposes other than those for which it was collected or in accordance with applicable laws. From time to time, we may wish to use personal information for new or additional purposes, in which case we will amend the Privacy Policy to include these new or additional purposes and will obtain your consent through your continued use of our Platform and Services.

We may generate anonymous data from personal information collected through the Services by removing information that makes the data personally identifiable to an individual. We may use this anonymous data and aggregated data for any reasonable purpose and disclose such data to third parties in our sole discretion. For example, we may use anonymous data generated from your use of your device and our Services to help our user base better diagnose and remedy problems with their devices and Services. If a solution on your device was successful, we may share that information with other users with the same device so that others may benefit on an anonymized basis.

We retain your personal information only for as long as we need it to fulfill the purposes for which it was collected, to ensure your compliance with our Terms of Service, and to comply with our legal obligations.

5. To whom do we disclose personal information?

We may disclose personal information to and for the following purposes:

Others working for Cybersuite. Cybersuite uses certain trusted third parties to help us provide, improve, protect, and promote our Platform Services. These third parties will access your information only to perform tasks on our behalf and in compliance with this Privacy Policy.

Your Condominium Corporation, Condominium Developer or their Property Management Companies. Our Platform and Services display information like your contact information to your Condominium Corporation, Condominium Developer and their respective Property Management Companies.

Other applications and hardware. You can also give third parties access to your information and account - for example, via Cybersuite APIs or our third party hardware vendors. Their use of your information will be governed by their privacy policies and terms of use.

Legal Requirements. We reserve the right to disclose any personal information as needed if such information is requested by law enforcement agencies that possess warrants or if we are requested to do so by law, regulation, court order, or by a government entity. We may also disclose your personal information to third parties if we have reason to believe that disclosing such information is necessary to: (i) conduct investigations of possible breaches of law; (ii) cooperate in any legal investigation; (iii) identify, contact, or bring legal action against someone who may be violating our Terms of Use; or (iv) to protect our rights, privacy, safety or property.  We may also disclose your information to third parties if we determine that such disclosure is reasonably necessary to (a) comply with the law; (b) protect any person from death or serious bodily injury; (c) prevent fraud or abuse of Cybersuite or our users; or (d) protect Cybersuite's property rights.

Acquisitions. We reserve the right to transfer any personal information that we have about you if we sell or transfer all or a portion of our business or assets to a third party.

Additional Purposes.  Lastly, we may disclose your personal information for any other purpose to which you consent.  However, we will not sell your personal information to advertisers or other third-parties.

6. Location

As discussed above, we may engage third parties to perform certain services on our behalf and to otherwise provide our Platform and Services. These third parties may store, process and transfer personal information on servers located outside of Canada in jurisdictions whose data protection laws may differ from those of Canada, such as the United States of America. As a result, personal information may be subject to access requests from governments, courts, or law enforcement in those jurisdictions according to the laws in those jurisdictions. For example, information may be shared in response to valid demands or requests from government authorities, courts and law enforcement officials in those countries. Subject to applicable laws in such other jurisdictions, we will use reasonable efforts to ensure that appropriate protections are in place to require our third parties to maintain protections on personal information that are equivalent to those that apply in Canada.

7. Links to Other Sites

Our Platform and Services may contain links to the platforms of our subsidiaries and affiliates, and to sites that are independently owned and operated by third parties. These other sites may have their own privacy policies and are not governed by this Privacy Policy. Cybersuite is not responsible for the privacy practices or the content of any site(s) owned and operated by any such subsidiaries, affiliates or third parties. Other organizations may collect and treat personal information collected differently, so we encourage you to carefully read and review the privacy policy for each website you visit.

8. Security

We maintain technological, physical and organizational security safeguards to protect your personal information against loss, theft, and unauthorized access. Any personal information that you provide to us is exchanged on a secure server. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we are committed to protecting your personal information, we cannot ensure or warrant the security of any information you provide to us.

We take reasonable steps to verify your identity before granting you access to your account on our Platform, however, you are solely responsible for maintaining the secrecy of your username, password and any other account information. We also take reasonable steps to ensure that our employees are aware of the importance of maintaining the confidentiality of personal information and that unauthorized persons do not gain access to personal information that we have disposed of or destroyed.

9. Individual Access and Accuracy of Personal Information

We support your right to access personal information that we have collected about you. You may request access to your personal information which we may hold by contacting us at the contact information set forth below, and we will respond within the time periods provided for under applicable laws. We will need to verify your identity before providing you with the personal information we hold about you. There is no cost for such access request unless you require copies of records. We may not be able to provide you with access to your personal information if the information cannot be separated from the personal information of others, cannot be disclosed for reasons of security or commercial confidentiality, or is protected by legal privilege. If we cannot provide you with access to your personal information, we will advise you of the reasons access is being denied, unless we are prohibited by law from doing so.

You may request to update and change your personal information at the contact information set forth below. We shall endeavor to correct or complete any personal information which you advise us is inaccurate or incomplete. Where appropriate, the amended information shall be transmitted to third parties having access to such information.

10. Children’s Privacy.

We are committed to protecting the privacy of children and we do not knowingly solicit personal information from children under the age of thirteen (13). If a child has already provided us with personal information, his or her parent or guardian may contact us for the purpose of deleting this information, and we will promptly delete such information.

11. Changes to this Privacy Policy

We reserve the right to change or replace this Privacy Policy at our sole discretion at any time. Please check back from time to time to ensure that you are aware of any updates or changes in this Privacy Policy. We will post the most current version on our website (https://cybersuitex.com/privacy) and we will indicate at the top of this page the date this Privacy Policy was last revised. Your continued access or use of our Platform and Services after any such changes constitutes your acceptance of the Privacy Policy as revised.

12. Your Consent to the Terms of this Privacy Policy

By using our Platform and Services and providing us with your personal information, you agree that Cybersuite may collect your personal information and you voluntarily consent to the collection, use, disclosure and transfer of your personal information in accordance with this Privacy Policy. If you do not agree with any terms of this Privacy Policy, please do not use our Platform or Services or provide us with any personal information. If you do not understand the nature, purpose and consequences of us collecting, using and disclosing your personal information, please do not use our Platform or Services or provide us with any personal information, and contact us at the contact information set forth below so that we can address your questions or concerns.

Subject to legal and contractual requirements, you may refuse or withdraw your consent to certain of the purposes identified in this Privacy Policy at any time by contacting us at the contact information set forth below. If you refuse or withdraw your consent, you acknowledge that we may not be able to provide you or continue to provide you with certain services or information which may be of value to you.
